The actress, who announced her divorce from Cruise on Friday (June 29), was alleged to have filed an emergent application in New York on Tuesday (July 3), which would have given her "temporary emergency relief" for their daughter Suri, 6, and forced Cruise into a public court hearing there later this month.

Sources even claimed to Hollywood Life that Holmes filed the application because she "doesn't anticipate Tom cooperating" and warned that the decision to go to court was a sign of "a contentious divorce battle to come".
In response, Holmes's attorney Jonathan Wolfe informed People: "Other than her action for divorce, the only pending application filed by Ms Holmes remains her request for an anonymous caption [where papers in the case are filed anonymously]."
Cruise's lawyer Bret Fields seemed to confirm yesterday (July 4) that the star would file a rival divorce case.
It has been alleged that Cruise wants proceedings to take place in California, where he will have a better chance of gaining full custody of Suri.
